ADR Systems Design

We work with each client to design and implement an alternative dispute resolution (ADR) system specifically tailored to the client's unique needs. The scope of work can range from providing off-site mediation services to comprehensive ADR design, including risk and needs assessment, training, implementation, and ongoing program maintenance.

Arbitration

Some conflicts require the need of a third-party decision maker, such as where the only issue is monetary damages and the disputants are not concerned about improving future interaction. In arbitration, the parties present evidence to the arbitrator in a formal hearing, which results in an award — typically a win/lose decision. Our arbitrators help the parties design a hearing process, rule on the admissibility of evidence, and render an award, with a written explanation if requested.

Facilitation

At some time, groups both large and small become bogged down or embroiled in conflict. Our facilitators help groups restore and maximize their ability to work together by skillfully generating a rich level of participation; surfacing all perspectives, including less popular views; and guiding group members through proven problem-solving techniques which can be applied to both present and future issues.

Interest Based Negotiations

Interest based negotiations provide greater satisfaction and more durable agreements than traditional positional bargaining. The interest-based approach can be used for bargaining in a wide range of areas, including labor contracts, public policy, reorganization, and many other types of negotiations. Participants use a process and are guided in developing the skills necessary to negotiate in a collaborative style.

Mediation

This is an informal, confidential, voluntary process in which parties are encouraged to work together to create solutions that are right for them. Our experienced mediators have the expertise to enable participants to clearly identify underlying issues, interests and needs; develop realistic visions of what they can achieve; and structure solutions that are both doable and durable. Mediation is especially powerful when the participants are concerned about protecting their ongoing relationship.

Myers-Briggs Type Indicator Workshop

The Myers-Briggs Type Indication (MBTI) provides a useful method of understanding people by looking at personality preferences that affect us in work and personal relationships. During the introductory workshop, the MBTI instrument is administered. Participants review their own results and then join a group discussion about the effects of type in their immediate situations. The workshop can be customized to increase awareness for work teams, families, or individuals. Workshops are presented by a MBTI certified instructor.

Ombuds Services

Often the use of "official" channels in companies and organizations to handle disputes involves lengthy delays, fear of lack of impartiality, confidentiality, and even retaliation. Inevitable outcomes are declines in morale up to costly litigation. Our nationally-recognized Ombuds group provides neutral, confidential, independent, informal complaint handling services to management and non-management employees at all organizational levels to resolve both individual and systemic conflicts. We also provide ongoing, external, independent, Ombuds services tailored to the individual needs of our clients.

Training & Custom Services

Our team of experienced dispute resolution specialists and trainers is ready to meet your staff development needs. We are available to present training workshops at a time and location convenient for you, and to custom-design presentations specifically for your organization.
